REGISTRATION - TERMS and CONDITIONS
As part of the registration process for the PASA International Payments Conference (PIPC), delegates must agree, without limitation, to comply with the terms and conditions of registration as set out in this document.
1. ACCEPTANCE OF CONDITIONS
By registering for PIPC, and for and in consideration of PASA allowing you to register, attend, and participate in the event, you accept these terms and conditions.
You acknowledge and agree that the Event Organiser will have sole authority and be the final arbiter on all decisions relating to the safety, running, and organisation of the event, including the timings/finish times and other conference items.
2. DEFINITIONS
The following definitions and rules of interpretation apply in this agreement.
Business Day: a day other than a Saturday, Sunday or public holiday in the Republic of South Africa.
Event: the PASA International Payments Conference will take place on 9 and 10 October 2023 at the Venue.
Event Organiser/PASA: the Payments Association of South Africa, the owner and organiser of the event.
Delegate: a person who registers and/or attends or participates in the event.
Venue: means the premises where the event is to take place, which is the Sandton Convention Centre, Sandton.
3. WEBSITE DISCLAIMER
The Event Organiser is not responsible for any inaccurate registration information, whether caused by website users or by any of the equipment or programming associated with or utilised in the event. The Event Organiser assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission of any website or material related to the event, or for communications line failure, or for theft or destruction, tampering, or unauthorised access to registrations, participation and/or registration information.
The Event Organiser is not responsible for any problems or technical, hardware, or software malfunctions of any telephone network or telephone lines, failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the Event Organiser or by any of the equipment or programming associated with or utilised in the event, failure of any email, submission or registration not received by the Event Organiser due to technical problems, human error or traffic congestion, unavailable network connections on the Internet or any website, or any combination thereof, including any injury or damage to the Delegate’s or any other person’s computer relating to or resulting from participating in the event or downloading any materials related to the event.
The Event Organiser reserves the right, at its sole discretion, to remove any individual it finds to be tampering with the registration or submission process or the operation of the event or the website, or any website related to the event.
If, for any reason, the event is not capable of running as planned by reasons beyond the control of the Event Organiser, including without limitation technical failures, or anything which, in the sole opinion of the Event Organiser, affects the administration, security, fairness, integrity or proper conduct of the event, the Event Organiser reserves the right, at its sole discretion, to void suspect registrations or submissions and/or to cancel, terminate, modify or suspend the event.
The Event Organiser has no obligation to operate or produce the event (or any part thereof) and no obligation to broadcast the event, even if the event takes place.
IN NO EVENT WILL THE EVENT ORGANISER BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR DAMAGES ARISING OUT OF ACCESS TO AND USE OF THE EVENT WEBSITE OR THE DOWNLOADING FROM AND/OR PRINTING OF MATERIAL DOWNLOADED FROM THE WEBSITE.
4. EVENT ORGANISER RESPONSIBILITIES / LIMITATION OF LIABILITY
The Event Organiser shall not be liable to the Delegate for any loss or direct, indirect or consequential damage, whether arising under contract, delict, breach of statutory duty or otherwise, to personal equipment or property belonging to the Delegate, or damage whatsoever arising out of the Delegate taking part in the event, including any loss of business, revenue or profits, anticipated savings or wasted expenditure, or loss of reputation. The Event Organiser will not be liable for any actions or omissions of any Delegate or other third parties.
As a Delegate, you irrevocably renounce the right to any recourse or claims whatsoever against the Event Organiser, its employees, officers, directors, agents, sponsors, suppliers, contractors, sub-contractors, medical advisers and/or any other person involved in the organisation of the event (“Associated Parties”), as a result of any kind of physical, mental or other loss or damage of whatsoever nature suffered by you or your agents, employee’s or representatives, directly or indirectly, or caused by an event in any way relating to your participation in the event. As Delegate, you indemnify the Event Organiser and the Associated Parties and hold them harmless against any claim, actions, liability or losses from any breach of the declarations above.
Nothing in these Terms and Conditions shall operate to exclude or limit the liability of the Event Organiser where prohibited by law.
5. DELEGATE INDEMNITY
You voluntarily, knowingly and freely assume all risks associated with attending and participating in the event, including, but not limited to, your own actions or inactions, the actions or inactions of others, including your employees, representatives or invitees to the event.
You undertake to participate entirely at your own risk. You agree that you shall have no claims whatsoever against the Event Organiser, and/or Associated Parties or any of the instructors, speakers, members, other participants or the Venue (“Indemnified Parties”) in respect of any loss or damage whatsoever, which you may suffer (collectively referred to as “Loss”). This includes any injury to your person or loss or damage to property as a result of, or arising out of, whether directly or indirectly, your participation in the event, including your arrival and departure therefrom and attendance of any ceremony and function thereof, however, such loss may arise and regardless of whether or not same shall have been caused directly or indirectly by fault or negligence, of one or more or all of the Indemnified Parties. You hereby indemnify and hold harmless the Indemnified Parties against all loss.
You accept all and any financial responsibility which you may incur due to negligence and or injury caused by your participation within the event. Further you absolve fully the Event Organiser and the indemnified Parties from any legal costs incurred to enforce this agreement and will reimburse them for all and any costs incurred to enforce this agreement.
6. EVENT REGISTRATION CONDITIONS
I represent and warrant to the Event Organiser that I have full legal authority to complete this event registration on behalf of myself and/or any person I am registering (Registrant(s)), including full authority to make use of the credit or debit card to which registration fees will be charged.
7. REGISTRATION FEES
All registration fees are inclusive of VAT, currently at the rate of 15%.
I acknowledge that I shall not be eligible or entitled to participate in the PIPC Event until full payment of the Registration Fee has been received by the Event Organiser. If registration is accepted, the Registration Fee is non-refundable other than as otherwise stated in the cancellation policy.
The following Registration Fees shall apply:
EARLY BIRD REGISTRATION FEES
Registration Fees are applicable only to those Delegates who book and pay between 9 May 2023 and 9 June 2023. Should we not receive your payment or **proof thereof by 9 June 2023, your registration will then automatically be converted to the Regular Registration Rate.
REGULAR REGISTRATION FEES
Registration fees are applicable only to those delegates who book and pay between
9 June 2023 and 30 September 2023. Should we not receive your payment or **proof thereof by 30 September 2023, your registration will then automatically be converted to the Late Registration Rate.
LATE REGISTRATION FEES
Registration fees are applicable only to those delegates who book and pay between 1 October 2023 and 6 October 2023. Should we not receive your payment or **proof thereof by 6 October 2023, your registration will be marked for payment onsite. Failure to pay in full at the onsite check-in will result in the Delegate not gaining access to the conference. Non-attendance to the conference does not constitute a registration cancellation, and the Delegate will be held liable for 100% of the registration fee.
NON-PAYMENT AND DEBT COLLECTION
All outstanding accounts will be handed over for debt collection within 3 weeks of the conclusion of the event. All applicable penalties and costs (including legal costs) will be for the Delegate’s own account.
**Proof of Payment may constitute: Bank-generated proof of payment document, Remittance Advice or Government Issued Purchase Order.
8. CANCELLATION POLICY
No telephonic cancellations will be accepted.
The following cancellation charges will apply:
• Written cancellations received before 31 July 2023 will have a 40% charge of the total fee.
• Written cancellations received before 31 August 2023 will have a 70% charge of the total fee.
• Written cancellations received from 1 September 2023 will have a 100% charge of the total fee.
• No-show delegates will not receive a refund.
• If you are unable to attend the conference, a substitute delegate is welcome to take your place.
• Any changes required in attendance should be directed in writing to the Conference Organisers on registrations@pipc.co.za.
• All requests for registration cancellations and refunds to be forwarded in writing to registrations@pipc.co.za.
• Refunds will only be done AFTER the Conference has ended.
• The Event Organiser cannot be held responsible for double registration. In these cases, cancellation policy will apply.
• Non-attendance to the conference does not constitute a registration cancellation, and the Delegate will be held liable for 100% of the registration fee.
9. DISCLAIMER AND ALTERATIONS TO THE EVENT
In the event that any services become unavailable for any reason, the Event Organiser, its appointed agents and other sub-contractors will make every effort to supply alternatives of equal standard and value, but no responsibility can be accepted for failure to provide the specific services.
You acknowledge that it may be required that alterations are made to the event from time to time. Any change to the event start time or format will be communicated to the Delegate as soon as is reasonably practicable.
Programme Alteration – the Event Organiser reserves the right to amend the Programme at their sole discretion in order to stage the event.
Other Alterations – You acknowledge and accept that circumstances concerning the event may change from time to time for reasons out of the Event Organiser’s reasonable control, without any rights to withdrawal being accrued by the Delegate other than as set out in the withdrawals policy, and without the Event Organiser incurring any liability. For illustration purposes, these changes may include car parking arrangements or course alterations, but such changes/issues will not allow the Delegate to withdraw and nor will the Event Organiser be deemed liable except as otherwise set out herein.
10. EVENT CANCELLATION
In the event that the event cannot be held or is postponed due to events beyond the control of the Event Organisers (force majeure) or due to events which are not attributable to wrongful intent or gross negligence of the Event Organisers, the Event Organisers cannot be held liable by Delegates for any damages, costs, or losses incurred, such as transportation costs, accommodation costs, financial losses, etc. Under these circumstances, the Event Organisers reserve the right to either retain the entire registration fee and to use it for a future conference or to reimburse the Delegate after deducting costs already incurred for the organisation of the event.
11. COMMUNICATIONS
You acknowledge that the Event Organisers will primarily use email, sms and social media platforms to communicate with Delegates. To ensure receipt of all Event information, you accept sole responsibility to ensure that you provide the Event Organiser with the correct email address and to inform the Event Organiser of any changes to these prior to the event as soon as is reasonably practicable. The Event Organiser shall not be held responsible for any computer malfunctions or other technical anomalies that may occur in the process of sending out such email communications that may lead to failure of receipt by the Delegate.
The Event Organiser can be contacted by the below methods of communication and shall endeavour to respond to Delegate enquiries within two (2) Business Days of receipt of the correspondence.
12. MEDIA AND PHOTOGRAPHY
As a Delegate in the Event, you irrevocably consent to be filmed, recorded and photographed at the event and for the video footage, recordings and images to be incorporated and exploited in whole or in part in any television programme, film, video or broadcast of whatever nature, and in all media for the purpose of advertising, publicity and otherwise in relation to the exploitation and/or promotion of the event (and future events).
Any film, photographs, or any other recording of moving or still picture shall remain the property of the Event Organiser. Accordingly, any such recording by the Delegate shall not be used other than for private use without the Event Organiser’s prior written consent.
13. DATA PROTECTION
You agree that your personal information can be stored and used by the Event Organiser and event partners/sponsors in connection with the organisation, delivery and administration of the event and may be used by the Event Organiser and event partners/sponsors in connection with the compilation of statistical information and to improve the procedures at future events.
Medical information and Emergency contact details are only collected for health and safety purposes to allow medical assistance to be given on the Event date.
Personal information or marketing information pertaining to the Delegate shall not be used or reproduced in whole or in part in any form except for events related to PIPC.
